Radio Host Jordana Green Interviews Joe Tamburino about Bill Cosby Case

Posted By Caplan & Tamburino Law Firm, P.A. || 31-May-2016

Attorney Joe Tamburino was recently interviewed by radio host Jordana Green about the Bill Cosby sexual misconduct case and the punishment the comedian could be facing if convicted.

Cosby has waived his right to a formal arraignment in a Pennsylvania sexual assault case. Just recently, he was forced to stand trial in a criminal case alleging that he molested dozens of women over the past few decades. The statute of limitations has not yet expired in this case (as it has in many others), making this the lone criminal case against Cosby.

According to Mr. Tamburino, Mr. Cosby has two charges of sexual assault being brought against him, which each carry a penalty of 10 years in prison. There is clearly probable cause to believe that Mr. Cosby may have committed a crime based on a number of statements he made back in 2005, so the case will certainly move forward. However, whether or not he will be convicted is a completely different issue. He could face up to 20 years in prison, although he may not receive the full sentence.

Mr. Tamburino believes that the prosecutor may have difficulty if all he has to work with is the victim’s word against Mr. Cosby. However, if the prosecutor is able to use all of Mr. Cosby’s words plus the other information that’s out there about the rape allegations before 2005, the prosecution’s case will be much less difficult to prove. In his opinion, he believes this testimony will be allowed, and that the judge will let in at least some information from his prior acts so that the prosecution can establish a history of misconduct.

Cosby, now 78 years old, is currently free on a million-dollar bail. If convicted, Mr. Tamburino is sure that he will serve time in prison despite his age.
