Caplan & Tamburino Law Firm, P.A. Gets Unconstitutional Drug Charges Thrown Out

After 2 Montana men were arrested in Minnesota and charged with 2 counts first-degree drug sales, Attorney Hillary Parsons stepped in to defend one of the accused. It started when the men were pulled over on Interstate 94 in a routine traffic stop and ended in an unlawful search.

Minnesota State Trooper Aaron Myren pulled the men over due to their vehicle’s cracked windshield and their allegedly unsteady driving. He claimed seeing a camper on Interstate 94 was “unusual for that time of year.”

Upon searching the vehicle, Myren discovered more than $4 million worth of marijuana and other contraband, including over 900 pounds of pot. Our client was charged for this; however, because Myren’s seizure of the materials was illegal the case was dismissed.

A video of Myren’s traffic stop showed at least 5 other campers on the road. Additionally, our client’s driving was appropriate except for one minor error. Although a judge ruled that the windshield was enough to pull the men over, he found Myren’s search to be unwarranted, and thus, unlawful.

Because Myren’s search of the vehicle violated our client’s constitutional rights, any evidence against our client was ordered to be suppressed. Without this evidence, probable cause no longer existed to charge him or his companion with any other controlled substance crimes.

Thanks to the thorough review of all evidence by Attorney Parsons, the entire case against our client was dropped. Our client avoided up to 30 years of prison time and a $1 million fine.
