False Sex Crime Accusations: What Do I Do?

Sex crime allegations are nothing to be taken lightly. When accusations are made, the government will take them seriously and will devote extensive resources into investigating the situation, substantiating claims, and, when they feel they have a case, prosecuting the accused. As such, anyone facing a criminal allegation involving a sex crime needs to also take accusations as seriously as possible. Even if the accusations are false and you feel you can explain the true nature of the situation, you are still at risk of suffering severe penalties in a system that may lose sight of your story in the fervor of pushing for charges and convictions.

Even if the allegations are false and you feel that you can explain things away, talking puts you at risk of saying things that could be misinterpreted or used to connect you with knowledge of a crime, even if you were not involved. Ultimately, talking to law enforcement will not help; you won’t be able to talk yourself out of an arrest. Instead, you should exercise your Fifth Amendment right and ask to speak with a lawyer.
  • Presumption of innocence – Although societal opinions regarding sex crimes may make some quick to judgment, it bears reminding that our criminal justice system is founded on the presumption of innocence. This means you are innocent until proven guilty, and that it is the government’s responsibility to prove the allegations made against you. If they are unable to corroborate evidence when a false accusation is made, and you and your attorney are able to present a clear and convincing defense for what actually occurred, it makes the prosecution’s task of gaining a conviction exceedingly difficult and can be grounds for dropping an investigation or pending charges.
