Attorney Tamburino Represents Man in Restraining Order Case Pro Bono

Attorney Joseph Tamburino, partner of Caplan & Tamburino Law Firm, P.A. in Minneaoplis, is handling a pro bono restraining order case to protect a Good Samaritan who assisted police arrest two suspects last month. The Good Samaritan shall not be named to preserve his privacy and continued protection.

The Good Samaritan was walking down the street in May 2017 when he noticed two people litter on the street while seated in their vehicle, police statements state. After he told the two men to pick up their trash, he started to write down their license plate information when they would not comply. This is when the men became confrontational and aggressive, exiting their vehicle and intimidating the Good Samaritan by indicating that they were armed.

Police officers came to the scene shortly after the Good Samaritan got their attention. The two men continued to be belligerent, prompting the police to believe that they were indeed dangerous. When the men were placed in the squad car, police officers searched their vehicle and found multiple weapons, including a hand grenade, assault rifle, handgun, and an ammunition cache. There was also electronic parts that could be used to build a drone.

Interestingly, Majid Al Rifahe was only charged with misdemeanor assault and disorderly conduct before being released. The other man and Majid’s brother, Abdullah, was charged with a felony gun crime for carrying a pistol in public with no permit. He had received a conviction for the exact same crime only a few months prior. Due to the repeat offense, he was kept in jail – and still remains there – with a $200,000 bond.

Only a few days after the arrests, Majid drove up to the Good Samaritan, who is 62-years of age and lives with debilitations. Majid intentionally drove on the wrong side of the road to close the gap between him and the Good Samaritan, all the while staring at him menacingly. He made a hand gesture that was meant to convey a threat before driving away. This is the incident that has necessitated the protective restraining order.
